  According to the draft, e-commerce companies should not "directly or indirectly affect the prices of goods and services" but need to "maintain a level playing field." The draft rule states: "(E-commerce companies should not) adopt any unfair methods or deceptive practices that may affect shoppers' purchasing decisions in order to promote the sale, use, and supply of goods or services." The draft rule also prohibits e-commerce sellers from impersonating consumers and posting comments, distorting or exaggerating the quality or characteristics of goods and services. E-commerce companies must also provide detailed information about the seller, including their business identity, legal name, primary geographical location, website name, products sold, and contact information with customers.

  According to the draft, e-commerce companies should ensure that customers’ personally identifiable information is protected and that the collection, storage and use of such data are in compliance with the provisions of the Information Technology (Amendment) Act of 2008. Another provision requires e-commerce companies to accept customers' return requests in the event of delayed delivery, product defects, mis-issuance or fraud, and refund all payments from customers within 14 days. The proposal also requires e-commerce companies to disclose the contract terms signed with sellers related to returns, refunds, exchanges, warranty/guarantees, delivery/shipment, payment methods, appeal handling mechanisms, etc.

  CAIT (Indian Traders Federation) Secretary-General Praveen Khandelwal said the move will promote transparency, fairness and greater responsibility for e-commerce companies.
