After the implementation of the E-commerce Law, the impact on purchasing agents has become more obvious. Soul painters and jokers have emerged one after another. However, the editor still wants to focus on Taobao sellers, mainly talking about the two aspects of business licenses and cashback that everyone is more concerned about.
It is difficult for sellers to apply for certificates, and "running naked" is not the original intention
Every day, thousands of Taobao sellers in Hangzhou alone apply for business licenses. However, many sellers are worried and helpless about the processing process, incomplete information required, large number of people handling, and untimely service of the waiter.
1. Application for Taobao certificate for web business
In addition to applying for a business license online, Taobao sellers in Hangzhou can also apply for it through the Hangzhou Market Supervision and Administration Bureau.
First, you must first apply for a Taobao certificate for web page business from Taobao, then go to the Market Supervision and Administration Bureau in the area where your permanent address is located to apply for an electronic license, and then register at the Zhejiang Provincial Industrial and Commercial Full-process Electronic Registration Platform according to the prompts.
Among these three steps, some sellers reported that they were stuck in the first step and could not take the following two steps if they could not get the web page business certificate. I was afraid that I would not have time to apply for a certificate, which violated the e-commerce law.
2. Face cannot be recognized
A seller applied for a business license card online for facial recognition, so he went to the local Industrial and Commercial Bureau for consultation. However, the staff of the Industrial and Commercial Bureau also asked him to open the Taobao town website to register today. After understanding the situation, the staff could only ask him to consult the customer service staff. However, because there were too many registered people and there was only one customer service hotline and the staff also said they could do nothing.
Some sellers even went to Taobao town to find out the situation, but did not contact the relevant staff. Finally, they could only call, and the customer service also asked the seller to wait patiently.
The seller is also very worried about whether it will affect the business of his store.
3. The ID inspection review time is too long
Some sellers are stuck in Taobao ID detection, and the sellers are busy calling Taobao Town customer service phone number and cannot consult. Finally, Taobao Town issued an announcement: Recently, due to the large number of applicants for registration, the data proofreading review time will be extended.
However, I remind you to send friends not to be anxious or panic, wait for the improvement of Taobao town and the official notification, and do not believe in the nonsense of all kinds of agency licenses in the circle of friends that you have to close the store if you do not apply for a certificate before the end of January. Everything is subject to the official notification.
Cashback for positive reviews is prohibited, hoping to give time transition
The E-commerce Law stipulates that operators shall disclose product or service information comprehensively, truthfully, accurately and promptly to protect the right to know and choose between the counterparty or consumers of the transaction. No false or misleading commercial publicity shall be carried out by making transaction volume, fabricating user reviews, exaggerating efficacy, etc., to deceive and mislead the counterparty or consumers of the transaction.
But from the seller's perspective, cashback on good reviews is more about "buying good reviews", but about "attracting reviews". Therefore, some sellers believe that encouraging buyers to comment and buying comments are two different behaviors and should be managed separately.
At present, JD.com and Taobao have made relevant rules and announcements:
The "JD Open Platform Merchant Violation Points Management Rules" clearly states that induced positive reviews - the marketing content of "encouraging and guiding consumers to praise based on material or financial commitments" - is a violation. The rules stipulate that merchants who induce positive reviews will be dealt with with warnings, product declines, and store rights reductions depending on the severity of the behavior.
In the latest revised "Taobao Evaluation Standards" on December 31, 2018, although the behavior of inducing positive reviews is not clearly defined, it also emphasizes "ensure that the evaluation content can provide a reliable basis for consumers' shopping decisions and reflect the true situation of goods or services."
However, some sellers are still selling products on the platform with keywords such as "show pictures and cashback" and "good reviews and cashback". The sellers said: They are still in the wait-and-see stage, and the cashback promises made before still need to be fulfilled, hoping to adapt to the transition period.
But in fact, this phenomenon has long been banned on Taobao. In the Taobao and Tmall rules, "good review cashback" is an inappropriate marketing information. So, Xiaomi thinks it is better to regulate the store as soon as possible and not to wait until the day when she is at a loss.
Current situation: Only more than 10,000 Taobao stores have been fully launched nationwide
A non-public channel shows that as of January 1, 2019, the number of Taobao sellers exceeded 9.8 million. If other Internet e-commerce operators such as purchasing agents and micro-businesses are included in the supervision of the E-commerce Law this time, this number may exceed 10 million. However, according to the tracking and investigation by IT Times reporters, the specific data searched on Tianyan Check is only more than 10,000.
However, due to the high pressure of manual review in Taobao towns, the incomplete feedback mechanism of the website system, the unclear registration process of sellers, and the unclear division of responsibilities for e-commerce business licenses by relevant departments in some cities, the number of registered people has slowed growth and the platform's regular progress has been slow.
And some sellers still believe that e-commerce laws are far away from their lives and maintain an attitude that is irrelevant to them:
Many Taobao colleagues around me have not applied for business licenses; the waiter has not notified us to apply for a business license; the e-commerce law has a greater impact on purchasing agents than Taobao store owners; ......
I would like to advise you: Starting from January 1, the "E-Commerce Law" will officially come into effect. All Taobao sellers who do not apply for a business license should fulfill their obligations to apply for a license. The platform also has the responsibility to urge sellers to execute. This is something that requires both parties to implement together, rather than just waiting for the platform to push it away.
Conclusion
The implementation of the E-commerce Law will definitely have a positive guarantee for the entire e-commerce environment in the future. In the face of this change, e-commerce platforms do need a transition period.
The main reason for the "good review cashback" that has not seen a fundamental improvement in governance for many years is that it has experienced certain obstacles in practice and concept. Zhu Wei, deputy director of the Communication Law Research Center of China University of Political Science and Law and vice president of the E-Commerce Rule of Law Research Association of Beijing Law Society, said:
One of the problems with the E-commerce Law is that it is not stated that the law enforcement department and whoever is punished must be clear. At least, the market supervision and administration department has this power;
Secondly, it is impossible to solve many problems by an e-commerce law. The key to implementation is that other departments need to issue some specific regulations to supplement;
E-commerce law should be a constantly changing and developing system, and relevant departments need to issue detailed rules before they can discuss strict law enforcement.
