Starting from February 21, the "Taobao Rules" added the "Publishing Confused Information" rule to control merchants who publish confusing brands and products, and protect the legitimate rights and interests of the majority of brand merchants.

　　The rule of "release of obfuscated information" refers to the behavior of members in publishing information that is prone to confusing consumers. At the same time, in addition to adding the rules of "releasing confusing information", Taobao will clear out some brands that are prone to confusing consumers. Brands that have been removed will be intercepted when publishing products, and products that are still online will be deleted and delisted from the brand library. Merchants can self-check and correct the "confusing information" before February 28, and the clearance rules will be officially implemented from March 1, 2017 .

　　1. How to check and identify "it is easy to cause confusion in consumers"?

　　Answer: Taobao will capture the target brands and products through manual inspection or systematic inspection, and at the same time, verify and judge abnormal brand and product data from multiple dimensions such as brand LOGO pictures, product pictures, traffic behavior, evaluation data, after-sales data, and determine whether the brand or product constitutes consumer confusion based on the relevant feedback from consumers or the conclusion of the judgment of whether a specific brand or product constitutes confusion.

　　2. What kind of punishment will merchants who "post confusing information" be subject to?

　　(1) Release obfuscated information and deduct 2 points each time;

　　(2) The circumstances of publishing confusing information are serious, and 24 points will be deducted each time;

　　(III) If the circumstances of publishing confusing information are particularly serious, it will be deemed to be a serious violation and 48 points will be deducted each time.

　　At the same time, Taobao will take measures such as restricting the release of products, restricting website login, extending transaction account period, and store supervision depending on the severity of the circumstances.

　　3. What are the serious situations?

　　A: Including but not limited to:

　　(1) Members publish obfuscated information in large quantities or multiple times;

　　(2) If members publish confusing information and cause bad effects, such as causing a large amount of consumer damage or reporting.

　　4. How long will it take to relocate after these brands are cleared?

　　After the brand is cleared for 1 year, you can re-invest your application. After crowdsourcing review confirms that it is not easy to cause confusion, you can re-enter the brand library.

　　5. How to appeal?

　　Branded products involved in clearance do not support appeals. If the actual product sold is not the corresponding brand, please provide the actual product picture and explain the actual brand.

　　6. My brand is not on your list. Does it mean that there is no confusion in the trademark and there is no need to rectify it?

　　This list is only determined based on the current relevant data. In the later stage, Taobao will conduct timely statistics and analysis based on consumer complaints and refunds and reports, and combine relevant assessments of public review to determine whether there is consumer confusion in the brand. Therefore, it is not ruled out that other brands will fall into Taobao's brand list later. It is recommended that merchants operate honestly and strive to cultivate their own brands, and not use brand words that are easily confused with existing well-known brands.
