Following the bird's nest incident, Kuaishou's top anchor Simba has become a hot topic again! The reason is the same: selling fake goods!
A tragedy caused by a pair of yoga pants
During the live broadcast on the night of April 18, Simba and his anchor "Dandan" appeared in the live broadcast room and brought a pair of yoga pants called "YPL Sunscreen Cool Pants". At that time, two pairs of pants from "YPL" were sold, one for adults and the other for children, with live broadcast prices of 63 yuan and 50 yuan respectively.
According to Simba himself, there were 300,000 people in the live broadcast room, and 30% of them placed orders. The real-time orders on that day exceeded 100,000, and the sales of single items exceeded 6 million yuan in one night. As a result, after placing an order, some consumers went to the official flagship store of the YPL brand and found that this product was not available, so they questioned that the yoga pants sold by Simba were fake.
Good things don’t go out and bad things go thousands of miles away. Then Simba sold counterfeit goods again quickly spread on the Internet.
You argue with me one by one
After the news fermented, the Weibo of "YPL Official Trendy Products" issued two consecutive statements.
The first statement was on April 22. "YPL Official Trendy Products" said that a product called "YPL Sunscreen Cool Pants" sold on the Dandan Live Room was confirmed to be a product under the YPL brand without official authorization. Relevant distribution companies and production companies are not the official sales channel of YPL and do not have the qualifications for YPL brand marketing, authorized use, product production and sales. The brand said that it will hold relevant personnel and companies accountable and use legal means to protect their rights.

Subsequently, Xinxuan responded to the matter that night. Guangzhou Xinxuan Network Information Technology Co., Ltd. posted on its official Weibo that the company had conducted an inspection. After preliminary verification, the brand owner Harbin Aoshengyuan Trading Co., Ltd. provided our company with authorized links and relevant written materials. However, the company is still conducting further strict verification of these materials to ensure the authenticity, completeness and accuracy of the relevant materials of the brand.
Immediately afterwards, "YPL Sports Trendy Products" issued a second statement in the early morning of April 23, stating that Australia Health Industry Co., Ltd. had transferred the relevant trademark to Australia YPL Co., Ltd. on April 6, 2022. The trademark registered by a company in Harbin is a self-created graphic logo, which is very different from the products sold. The two infringing products sold by Xinxuan Live use the trademarks held by Australian YPL Co., Ltd.

This statement basically negates the brand's cooperative relationship with this Harbin company.
So on the morning of April 23, Xinxuan announced the preliminary investigation results, mentioning that the incident was caused by disputes before and after the trademark transfer of the trademark owner and did not belong to a fake.
Xinxuan said that he would reserve the right to pursue the damage caused by this incident, and all consumers who have purchased YPL products can contact Xinxuan customer service to apply for a full refund.
Whose pot came from the sky?
Judging from the latest progress, the problem should be in trademark authorization.
Xinxuan said that the original holder of the YPL trademark was Australia Health Industry Co., Ltd. In April this year, after the original trademark holder Australia Health Industry Co., Ltd. applied to transfer the trademark to Australia YPL Co., Ltd., there was a dispute over the two parties authorizing third parties to use the trademark before and after the transfer, so the trademark transferor said that the products promoted in the live broadcast room were "not under the YPL brand products."
Harbin Aoshengyuan Trading Co., Ltd. obtained the authorization from Australia Health Industry Co., Ltd. on January 1, 2021. The authorization period is from January 1, 2021 to December 31, 2026, and the authorization is transferable.
In other words, the authorization relationship between the original trademark holder and the authorized party Harbin Aoshengyuan Trading Co., Ltd., as well as the authorization relationship between Harbin Aoshengyuan Trading Co., Ltd. and Xinxuan are all within the validity period of the law.
A misunderstanding made People's Daily comment
On the afternoon of April 23, "YPL Sports Trendy Products" issued a statement for the third time, responding to the above results of Xinxuan's investigation, saying that it has never had any business cooperation with Harbin Aoshengyuan Trading Co., Ltd. and has no trademark authorization. Xin Xuan took out the power of attorney stamped by the company, which is a forged official seal and will be held accountable for the corresponding legal liability.

Subsequently, People's Daily Review (People's Daily Review is an exclusive online comment column launched by People's Daily Opinion Channel) also paid attention to this incident and commented that Simba was in a fake product storm again. At present, he saw that his parents said that his mother had reason and his mother said that his mother had reason, but there was only one truth. This matter involves public interests and legal issues, so the regulatory authorities also have the responsibility to intervene quickly. We cannot allow the two parties to "fight" the Internet, nor can we fail to finish it. Leaving an uncomfortable tail must be revealed.

Sure enough, things changed 360 degrees again. At 8:00 pm on April 23, "YPL Sports Trendy Products" issued the latest statement stating that the trademark authorization dispute involved in the "YPL pants promoted by Xinxuan's live broadcast room has not been officially authorized" has been properly resolved. The YPL brand apologized for the impact it has brought to relevant companies, netizens and Mr. Xin Youzhi.

This matter may be just a misunderstanding, and one party's imprudence caused trouble to the other party. However, as Xinxuan's official Weibo forwarded the above statement, the "fake goods storm" has come to an end. No matter what, this is a relatively peaceful ending, and no major losses are a good result. I hope that the majority of live broadcast rooms must have relevant understanding and strictly control before choosing to sell goods, protect the interests of consumers, and protect their own interests.
