  On June 8, the State Administration for Market Regulation held an administrative guidance symposium on the "6.18" online centralized promotion activities, requiring online trading platform (website) operators to strengthen their awareness of "first responsible persons" and fulfill their main responsibilities for online business in terms of platform governance, information disclosure, fair competition, consumer rights protection, advertising compliance, intellectual property protection, food safety, etc.

  The administrative guidance symposium on the "6.18" online centralized promotion activities was held, aiming to understand the specific situation of online trading platforms (websites) carrying out online centralized promotion activities and risk prevention, exchange experiences and practices of platform management, and reiterate regulatory requirements in combination with the problems existing in online centralized promotion activities in recent years, and strengthen the sense of responsibility of online trading platforms (websites) through administrative guidance.

  Online trading platform (website) operators are required to do the following:

  Consciously abide by the relevant provisions of the "Regulations on the Management of Online Transactions" and "Interim Provisions on the Management of Centralized Promotion Activities of Online Goods and Services" and other relevant provisions; consciously implement the obligations of pre-disclosure of promotional information, platform entry checks, and recording and preservation of promotional information; prohibit the restriction and exclusion of promotional operators in participating in promotional activities organized by other platforms through agreements and other means.

  Supervise and urge sales operators to consciously fulfill their promotional obligations, abide by the "Interim Measures for No-reason Returns on Seven-Day Online Purchase Products" and other relevant provisions. They shall not use standard terms to infringe on the legitimate rights and interests of consumers, shall not reduce the quality of goods due to promotion, and shall take the opportunity to use inferior products as good as good or fake as real; consciously abide by promotional information specifications and promotional advertising norms, shall not make misleading false propaganda and expression of goods and services, shall not publish false advertisements, shall not first raise prices and then discount, shall not falsely report special prices to attract customers, and shall commit fraudulent acts of pricelessness; it is prohibited to use fictitious transactions, transaction volume or false user reviews to promote promotions.

  Take necessary technical means to ensure the normal operation of the platform, consciously strengthen the management of the after-sales service team, promptly handle consumer complaints and trademark rights holders' complaints, formulate emergency plans for logistics and distribution of promotional activities, and provide consumers with more goods and services and services with excellent quality, practical prices and good service. It is prohibited to collect, use, disclose, and sell consumers and operators' personal information in violation of the principles of lawfulness, legitimateness and necessity.

  A relevant person in charge of the Internet Supervision Department said that in the next step, local industrial and commercial and market supervision departments should coordinate the monitoring and supervision work during the "6.18" online centralized promotion activities in accordance with the relevant requirements of the 2018 Net Sword Action Plan and other relevant work arrangements. Online trading platform (website) operators should actively cooperate with the work of industrial and commercial and market supervision departments, strengthen the awareness of "first responsible person", and effectively fulfill the main responsibilities of online business.

  At the symposium, the relevant person in charge of the rectification office of the State Food and Drug Administration informed the rectification work requirements for the rectification of fraud and false propaganda of food and health food.

  Relevant persons in charge of 12 online trading platforms (websites) including JD.com, Alibaba, Suning.com, Gome Online, Dangdang.com, NetEase Kaola, Beibei.com, and Vipshop attended the symposium.
