Profit driver uses QQ group to publish malicious attack tasks
As the group leader (nickname: Tianmeng - Team Leader), the defendant Yang has created multiple paid QQ groups before, and the group owner will charge a certain amount of group entry fee from the group. Usually, by sending promotion information within the group, members in the group are mobilized to promote products to merchants.

Originally, a normal and benign product promotion organization, due to the poor management of the organizers, the essence of the organization changed under the influence of interests and gradually became a gathering place for malicious attacks on merchants.
Tmall stores with large daily transaction volume and high average customer price are often the target of the gang's attack.
Through these groups, the defendant incited, organized and instigated members of the group to launch malicious attacks on the merchants. By capturing a large number of orders and then operating online returns, the merchant's inventory has been locked and cannot operate normally. The defendant took the opportunity to extort money from the merchants.

Through system monitoring and troubleshooting, Alibaba found that multiple accounts caused a large number of abnormal orders. He also collected evidence from relevant merchants and found out that the defendant Yang launched attacks on the merchants many times. Among them, he issued an attack mission before the " Double 12 " promotion last year. On December 11 alone, he placed more than 3,400 orders in Store A, involving 17,979 items, with an amount of more than 910,000 yuan. In March this year, another attack was launched on Store B, causing some of the products in the store to be removed from the shelves, and daily sales fell by more than 50% within a week.
This defendant's behavior that violates the principle of honesty and trustworthiness and generally recognized business ethics has damaged the legitimate rights and interests of the merchant and the plaintiff. In accordance with the "Anti-Unfair Competition Law of the People's Republic of China" and other laws and regulations, the plaintiff filed a lawsuit in accordance with the law: order the defendant to immediately stop unfair competition and compensate for related economic losses, close the QQ group involved in the case, and permanently block the group owner and group administrator accounts.
Protect the legitimate rights and interests of merchants and zero tolerance for malicious behavior
In daily transactions, in order to improve consumers' shopping experience, the platform formulates corresponding rules to protect consumers' rights and interests from infringement, which is also one of the important reasons why Taobao/Tmall is deeply loved and trusted by consumers.
However, in this case, the normal operation rules for ensuring the security and convenience of platform transactions and the rules for good faith protection of buyers were used with other intentions, seriously infringing on the legitimate rights and interests of merchants and seriously disrupting the healthy order of the platform and online shopping market.
Alibaba also has zero tolerance for such malicious attacks . Therefore, once similar improper behavior is discovered and verified, Alibaba will be punished accordingly and adopt legal protection based on the serious circumstances.
It is worth noting that on June 20 this year, the first case of "brushing orders" in the country was publicly sentenced in the Yuhang District People's Court of Hangzhou City. Li Moumou, a post-90s order brushing organizer, was sentenced to five years and six months in the first instance for committing illegal business operations, and was sentenced to five years and nine months in prison together with the original sentence of nine months in prison.
The acts of brushing orders and credit speculation have been "in prison". Using punishment to punish brushing organizers can be said to be a major judicial achievement and social progress.
