  A young man born in the 1990s was sued twice for selling fake Wuliangye

  In 2009, Xu Moumou, a born-in-1990s living in Shanghai, registered a Taobao store to sell high-end liquor. In order to make huge profits, Xu Moumou and others started selling counterfeit well-known brand liquor on the platform in 2015.

  In early May 2015, through big data model investigation, Alibaba Platform Governance Department found that Xu Moumou was suspected of selling fake products and pushed clues to Yibin Wuliangye Group, Sichuan Province. On May 14, Wuliangye Group confirmed through purchase appraisal that the "52-degree Wuliangye Crystal Pack" liquor sold by Xu Moumou was a fake, and Xu Moumou's store was later removed by Taobao.

  In September 2015, Wuliangye Group sued Xu Moumou to the People's Court of Xuhui District, Shanghai, demanding that he compensate him for various economic losses of 100,000 yuan. The court finally ruled that Xu Moumou had infringements such as knowing that fake sales were sold, and ordered the plaintiff to compensate 70,000 yuan.

  Alibaba stated in the complaint that the "Taobao Service Agreement" signed by Xu Moumou when he registered a Taobao store clearly stipulates that products that infringe on the Taobao platform that infringes on the intellectual property rights or other legitimate rights and interests shall not be sold on the Taobao platform, and all losses caused to the platform shall be compensated. In addition, the counterfeit sales of Xu Moumou and others have had an extremely bad impact on Taobao's reputation, and we must publicly apologize for this.

  At the beginning of this year, Zhang Kaif, assistant professor of marketing at Carnegie Mellon University in the United States, used purchase data from 603,000 Taobao consumers across five months to do an econometric analysis: purchasing a fake or inferior product of 1,000 yuan will lead to a consumer's consumption on the Taobao platform drop by 3,570 yuan in the next 12 weeks. "Compared with the comparison consumers, once a consumer purchases a fake, it will directly reduce his trust in the entire Taobao platform, which will further lead to a decrease in his shopping activity. This is the most direct loss of the platform." Professor Zhang Kaif said.

  Due to data limitations, this study only calculates the reduction in consumer shopping, and does not include the impact of word-of-mouth spread among consumers on the platform's goodwill, nor can it cover the long-term effect of "bad money drives out good money".

  So in the long run, e-commerce shopping platforms will only suffer more and less losses due to sellers selling fakes. This is also why Alibaba chose to sue the counterfeiter Xu on the grounds that "it violates the agreement that the platform is not allowed to sell counterfeit goods and infringes on the goodwill of the platform."

  This is not the first time Alibaba has taken up legal weapons in order to exhaust all means. In January this year, Alibaba has filed a lawsuit against a merchant selling counterfeit "Swarovski" jewelry on the platform, claiming 1.4 million yuan in compensation. This case is also the first domestic e-commerce platform sued the owner of a fake store. On April 25, the case of Alibaba suing the sale of fake "royal cat food" merchants was publicly tried in Fengxian District Court of Shanghai. Alibaba claimed 2.67 million yuan from the counterfeit merchants, which is also the first platform anti-counterfeiting case in China to open trial.

  "Fake goods are not only a pain for Alibaba, but also a pain for society. As victims of counterfeit goods, we must make counterfeit elements pay the due price." In response to the third case of prosecution of counterfeit sellers, Alibaba's chief platform governance officer Zheng Junfang said that the platform has compiled evidence of more than a dozen merchants selling counterfeit goods on the platform, and will initiate civil lawsuits in the future to hunt down counterfeit elements.
